These Terms of Service ("Terms") are a legal agreement between you and OperAi Group Ltd, a company registered in England and Wales (Company Number 17057467) with its registered address at Bartle House, Oxford Court, Manchester, M2 3WQ ("we", "us", "our", "OperAi").
By using our website, submitting an enquiry, or becoming a customer, you agree to these Terms. If you don't agree, please don't use our service.
OperAi provides AI-powered operational infrastructure for small and medium businesses, primarily in the UK trades and home services sectors. Our service includes lead management, automated communications (SMS, WhatsApp, voice), and operational dashboards.
We offer three subscription tiers: Core, Advanced, and Ultra, with pricing and features as described on our website. Pricing may change from time to time, but existing customers will be given reasonable notice of any increases.

Each plan includes a one-off setup fee, payable before implementation begins:
After setup, you pay a recurring monthly subscription fee corresponding to your chosen plan. Subscriptions are billed monthly in advance via Stripe.
Each plan includes monthly communications credits (calls, SMS, WhatsApp messages). Usage beyond your monthly allowance is billed at our then-current per-unit rates, or you can purchase additional Pro Comms Bundles at a fixed monthly rate.
If a payment fails, we'll attempt to recharge your card and notify you. If payment isn't received within 14 days, we may suspend your account access. Continued non-payment may result in account termination.
We offer a 21-day implementation guarantee. If we haven't successfully completed your initial setup and onboarding within 21 days of the setup fee being paid (excluding delays caused by you, such as not providing access or information we've requested), you can request a full refund of the setup fee.
Our subscriptions are month-to-month. You can cancel at any time by giving us at least 30 days' notice via email to [email protected]. You'll be billed for the final 30 days, after which your subscription ends and access is removed.
Setup fees are non-refundable after the 21-day implementation guarantee period has passed.

You retain all rights to data and content you provide through OperAi (your contacts, messages, customer information, etc.). By using our service, you grant us a limited licence to process this data solely as needed to provide the service.

On account termination, we'll provide you with a reasonable opportunity to export your data. After 30 days post-termination, we may delete your data from our systems unless required to retain it by law.
We aim for 99.9% uptime but cannot guarantee uninterrupted service. We may need to perform maintenance, updates, or repairs that temporarily affect availability. We'll give reasonable notice for planned maintenance where possible.
We're not liable for service interruptions caused by circumstances beyond our reasonable control, including third-party service outages (Twilio, Stripe, hosting providers, etc.), internet failures, or force majeure events.
OperAi integrates with third-party services including but not limited to GoHighLevel, Twilio, Stripe, and Microsoft. Your use of these third-party services may be subject to their own terms and policies, which we don't control. We're not responsible for the actions, content, or policies of third-party services.
All intellectual property in OperAi (including the platform, software, branding, content, and methodologies) is owned by or licensed to OperAi Group Ltd. Nothing in these Terms transfers any IP rights to you, except a limited, non-exclusive, non-transferable licence to use the service during your subscription.
OperAi is provided "as is" and "as available" without warranties of any kind, except those that cannot be excluded under UK law.
Any projections shown by our ROI Calculator or marketing materials are estimates based on industry research and the inputs you provide. Actual results vary significantly by business, industry, location, lead quality, and many other factors. We don't guarantee any specific revenue, conversion rates, or business outcomes.
To the maximum extent permitted by UK law:

We may terminate or suspend your account immediately if:
On termination, your access to the service ends. Sections of these Terms that should survive termination (including IP, liability, and dispute resolution) will continue to apply.
We may update these Terms from time to time. For material changes, we'll notify you at least 30 days before they take effect. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales, except where mandatory consumer protection laws give you the right to bring proceedings in your local jurisdiction.
